Telfort has to rectify on prime-time RTL4 and Nederland 1

27 March 2008 –Telfort has to rectify its misleading commercial on Vodafone as soon as possible on TV. The court in Haarlem decided on this in summary proceedings requested by Vodafone. In a commercial on TV and internet, which ran for several weeks, Telfort wrongly claimed that calling via Telfort’s network is up to EUR 117,- per year cheaper than with Vodafone. Telfort is forced to show the rectification twice, at the same times and on the same channels the commercial was originally broadcast, which included the commercial breaks around the Idols finals and Boer zoekt Vrouw. In addition, Telfort has to place rectifications on MSN and its own website.

Rectifications on TV are rare. De court took this exceptional measure since Telfort only ceased broadcasting the commercial several days after Vodafone’s summation. Hence, the commercial was still shown in the popular commercial breaks around the Idols finals and Boer zoekt Vrouw. According to the court, it would have been very well possible to also withdraw those.

In its commercial, Telfort compared the price of its 180 minute call bundle with Vodafone’s 200 minute bundle. From the advertisement, it did not become clear that, with Telfort, the text messages have to be paid separately, whereas with Vodafone text messages as well as several other services are deducted from the bundle prize. According to the court, this makes the commercial misleading.
