Vodafone's further thoughts on the Future of Privacy and regulation in the EU

In Vodafone’s Group Privacy Team, we spend a lot of time thinking and speaking out on what we see as the big picture with respect to privacy – not just the formal details of the legal framework for data protection, but what can be done to create and encourage commercial interfaces that truly balance business needs with privacy as a fundamental human right.

The European Commission’s review of the data protection directive, which has picked up steam this year, gives us a great opportunity to explore and discuss these issues. And so in response to their communication, A comprehensive approach on personal data protection in the European Union, we’ve filed a follow up to our 2009 white paper, The Future of Privacy – Vodafone’s Perspective.

The first part of this white paper sets out thematically what we believe are the key areas of focus for the Commission as it deliberates the future of European data protection and privacy regulation, and makes a number of concrete recommendations. The second part responds specifically to the points raised by the Commission in its communication. Some key themes we cover include:

  • The need for a revised directive to continue to meet the original purpose of facilitating the international flow of data so essential for the development of the information economy.
  • The need for a European regulatory model that is principles-based, adaptable and accountable.
  • Recommendations for a multi-tiered approach to regulated actors that will facilitate the emerging role of the data intermediary.
  • How a new approach to data protection will require that we rethink the current directive’s underlying concepts.
  • Important changes we can make to the directive to improve privacy protection globally in the absence of international political alignment.
  • How Privacy Impact Assessments can provide much-needed flexibility.
